Nintendo of America is taking legal action against the US government, seeking a refund of the tariffs imposed by former President Trump, which were recently deemed illegal by the Supreme Court. The company has filed a complaint in the US Court of International Trade, demanding a “prompt refund, with interest” of any duties paid.
The lawsuit is a result of the Supreme Court’s ruling that Trump’s use of the International Emergency Economic Powers Act (IEEPA) to levy “reciprocal” tariffs was unlawful. Although the ruling did not provide specifics on how refunds would be handled, Nintendo is pushing forward with its claim. The tariffs in question were announced on the same day Nintendo revealed launch details for the Switch 2, including a planned preorder date of April 9th.
The outcome of this lawsuit may have significant implications for Nintendo and other companies that have been affected by the tariffs.
